At Art R us, each work is curated with precision and presented under the highest standards of integrity, transparency, and professionalism.
As a premier destination for museum-quality contemporary art, Art R us operates within the established norms of the global fine art market, where acquisitions of original, rare, limited, and investment-grade works are considered final.
These Terms of Sale & Collector Agreement apply to all purchases and acquisitions made through Art R us, including website purchases, gallery purchases, art fair purchases, invoice purchases, phone or email transactions, wire transfers, card payments, private sales, commissions, reserves, and special orders.
FINAL SALE POLICY
Due to the exclusive, original, limited, and often one-of-one nature of the works represented by Art R us, all sales are final and non-refundable.
Art R us does not accept returns, exchanges, or cancellations on original works, commissioned pieces, limited editions, sculptures, installations, custom works, special orders, or reserved artworks.
Collectors are strongly encouraged to complete all desired due diligence prior to acquisition. Detailed information, including dimensions, medium, materials, provenance when applicable, and condition details, will be made available upon request. Additional photographs, video, and consultation may also be provided to support a fully informed acquisition.
ARTWORK AVAILABILITY
All works are subject to prior sale and availability.
An artwork is not considered sold until full payment has been received, cleared, and accepted by Art R us.
Art R us reserves the right to withdraw any work from availability at any time prior to final acceptance of a transaction.
Deposits, retainers, special orders, commissioned works, custom works, reserved artworks, and any artwork removed from availability at the collector’s request are non-refundable unless otherwise agreed in writing by Art R us.
PRICING AND PAYMENT
All prices are subject to change without notice unless confirmed in writing by Art R us.
Unless expressly stated otherwise in writing, pricing does not include shipping, crating, insurance, taxes, duties, customs, storage, delivery, installation, or other third-party charges.
Applicable sales tax, use tax, import duties, customs fees, and other governmental charges are the responsibility of the collector unless expressly stated otherwise in writing.
By completing a purchase, the collector agrees not to initiate a payment dispute, chargeback, reversal, or cancellation inconsistent with these terms after an artwork has been released, reserved, commissioned, delivered, transferred to a shipper, or otherwise made available according to the agreed transaction terms.
TITLE AND OWNERSHIP
Upon receipt of full cleared payment, title and ownership transfer to the collector, and the transaction becomes final and legally binding.
No copyright, reproduction rights, licensing rights, merchandising rights, trademark rights, or other intellectual property rights are transferred with the sale unless expressly granted in writing by the applicable rights holder.
SHIPPING, DELIVERY, AND RELEASE TO SHIPPER
Unless expressly stated otherwise in writing, the collector is responsible for arranging and paying for shipping, crating, insurance, storage, delivery,
installation, customs, duties, and related third-party services.
Shipping and delivery timelines are estimates only unless expressly confirmed in writing by Art R us. Art R us will coordinate in good faith with the collector and/or the collector’s designated shipper, carrier, agent, or third-party service provider.
If artwork is released to a collector’s designated shipper, carrier, agent, mover, installer, or other authorized third party, Art R us’s delivery obligation is deemed fulfilled upon that release, and risk of loss transfers to the collector at that time.
Any assistance provided by Art R us with shipping coordination is offered as a courtesy only and does not create liability for the acts, delays, damage, loss, or omissions of third-party providers.
DAMAGE CLAIMS
All artworks are professionally packaged and handled with care.
In the rare event that damage occurs during transit, the collector must notify Art R us in writing within 48 hours of confirmed delivery. Notice must include clear photographic documentation of the artwork, the packaging, and any visible damage.
Art R us will reasonably assist in facilitating a claim with the applicable carrier where appropriate. Failure to report damage within the required timeframe may result in denial of the claim, for which Art R us shall not be liable.
Collectors should retain all packaging materials until any shipping or damage claim is fully resolved.
WEBSITE ACCURACY
Art R us makes reasonable efforts to present artwork descriptions, images, dimensions, and availability as accurately as possible.
However, colors, textures, finishes, framing details, and scale may vary based on photography, screen settings, lighting conditions, and display environment. Art R us does not warrant that all website information will always be complete, current, or error-free.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Art R us shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or relating to any purchase, attempted purchase, shipment, delivery, installation, website use, third-party handling, storage, or transportation of artwork.
GOVERNING LAW AND VENUE
These Terms of Sale & Collector Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
Any dispute arising out of or relating to a transaction with Art R us shall be handled in the appropriate state or federal courts located in Collier County, Florida, unless otherwise required by law.
AGREEMENT
By completing a purchase through Art R us, the collector acknowledges and agrees to these Terms of Sale & Collector Agreement in full, confirming that all necessary information has been reviewed prior to acquisition and that the transaction is final, binding, and non-refundable.
