Collector Agreement

Due to the exclusive, original, limited, and frequently one-of-one nature of the artworks presented by Art R us, all sales are final and non-refundable except where required by applicable law or expressly agreed in a written transaction document.

Art R us does not accept returns, exchanges, or cancellations based on a change of mind for original artworks, commissioned pieces, limited editions, sculptures, installations, custom works, special orders, or reserved artworks.

Collectors are strongly encouraged to complete all desired due diligence before acquisition. Available information may include dimensions, medium, materials, provenance, condition information, additional photographs, video, and consultation.

Nothing in these Terms limits a right or remedy that cannot legally be waived, including applicable rights concerning merchandise that cannot be shipped as agreed.

All artworks are subject to prior sale and availability.

An artwork is not considered sold until the transaction has been accepted by Art R us and the required cleared payment has been received, unless otherwise confirmed in writing.

Art R us reserves the right to withdraw an artwork from availability at any time before final acceptance of a transaction.

To the extent permitted by applicable law, deposits, retainers, special orders, commissioned works, custom works, reserved artworks, and artworks removed from availability at a collector’s request are non-refundable unless otherwise agreed in writing by Art R us.

All prices are subject to change without notice unless confirmed in writing by Art R us.

Unless expressly stated otherwise, pricing does not include shipping, crating, insurance, taxes, duties, customs charges, storage, delivery, installation, or third-party services.

Applicable sales tax, use tax, import duties, customs charges, and other governmental fees are the collector’s responsibility unless expressly stated otherwise in writing.

Collectors should contact Art R us promptly regarding a payment concern before initiating a dispute. A collector must not knowingly initiate a false, fraudulent, or improper chargeback, reversal, or payment dispute. Nothing in this provision limits rights that cannot be waived under applicable law or payment-network rules.

Upon receipt of the required cleared payment, title to the physical artwork transfers to the collector as provided in the applicable invoice or transaction document.

Transfer of title to the physical artwork does not automatically transfer copyright, reproduction rights, licensing rights, merchandising rights, trademark rights, publicity rights, or other intellectual-property rights. Such rights transfer only when expressly granted in writing by the applicable rights holder.

Complimentary shipping within the United States is available on artworks priced under $3,000. For artworks priced at $3,000 or more, shipping is quoted individually based on dimensions, weight, packing requirements, and destination. Gallery pickup is complimentary. Online checkout is for gallery pickup only; contact [email protected] before completing payment to arrange shipping. Except for the complimentary shipping stated above or services expressly included in writing, the collector is responsible for shipping, crating, insurance, storage, delivery, installation, customs charges, duties, and related third-party services.

Shipping and delivery timelines are estimates unless expressly confirmed in writing. Art R us will coordinate in good faith with the collector and the collector’s designated shipper, carrier, installer, agent, or other service provider.

If Art R us cannot ship within an expressly promised timeframe, Art R us will provide the notice and options required by applicable law, which may include consent to a revised shipping date or cancellation and a prompt refund.

When the applicable written transaction document creates a shipment contract, risk of loss transfers when the artwork is duly delivered to the authorized carrier, to the extent permitted by law. When the written transaction requires delivery to a specified destination, risk of loss transfers as provided by that agreement and applicable law.

Assistance provided by Art R us with shipping coordination is a courtesy and does not create responsibility for the independent acts, delays, damage, loss, or omissions of a third-party provider, except to the extent liability cannot legally be excluded.

Artworks are professionally packaged and handled with care.

To help preserve a carrier or insurance claim, the collector should notify Art R us in writing promptly and, when reasonably possible, within 48 hours after confirmed delivery. The notice should include clear photographs of the artwork, packaging, shipping label, and visible damage.

Art R us will reasonably assist with a claim involving the applicable carrier or insurer when appropriate. Delayed reporting may affect the carrier’s or insurer’s ability to investigate or accept a claim.

The collector should retain all packaging materials until the matter is fully resolved. This section does not limit a right or remedy that cannot legally be waived.

Art R us makes reasonable efforts to present artwork descriptions, images, dimensions, materials, and availability accurately.

Colors, textures, finishes, framing details, and perceived scale may vary because of photography, lighting, screen settings, and display conditions. Collectors should request additional information when a particular characteristic is material to an acquisition.

Website information may be corrected or updated without notice. Confirmed written transaction documents control over general website content for the applicable transaction.

To the fullest extent permitted by applicable law, Art R us will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from an acquisition, attempted acquisition, shipment, delivery, installation, website use, or third-party service.

Nothing in these Terms excludes or limits liability, rights, or remedies that cannot legally be excluded or limited.

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute arising from a transaction with Art R us will be handled in the appropriate state or federal courts located in Collier County, Florida, unless applicable law requires otherwise.

By completing a purchase through Art R us, the collector acknowledges and agrees to these Terms and the applicable transaction documents, confirms that necessary information has been reviewed before acquisition, and understands that the transaction is final and binding except where applicable law or a written agreement provides otherwise.
